So if you know who did it you bring a civil case against them for damages. If the police have served a judgement and fine you are pretty much in the clear as far as responsibility goes. Small claims court, £500 towards repairs No contest....... He would have to prove he was not at fault and he cant do that if the po-lice hav been involved. I would also attempt to raise the charges to criminal damage and get them a proper record of the occasion..
Re the rear panel dameage? just stick your hand in down the side of the wing from the boot and push that out. I bet with a decent push most of that would just pop right out. Write off. lol.. not near.

I spoke to @newkid late last night about this and understandably he doesnt want to go into too much detail about what happened - just enough to say he was helping someone out and they turned nasty
It does sound like the rear quarter damage is worse than the pictures actually show
newkid was round at my place just last week and i had a look at the car and it was spotless so wont be easy to find another in that condition.
On the upside i can start persuading him to get a 4th gen as a replacement

A decent bodyshop could pull that rear quarter dent out in minutes using a TIG welder. I stood and watched a guy do worse than that including a mould line, and you would never had known it had been damaged.

A real shitter of a situation then, by the sounds of it.
My rear quarter looked like that after (similar to Merlin) a 4x4 reversed into it. Hard to judge from those pictures but where it goes in it must come out somewhere, I wouldn't be surprised if the panel has ripples further down. Definitely repairable though, I would've thought? Only reason I didn't with mine was because it was rusty and pretty much detonated on impact.

What dont we know about this situation and how it got to this point then? It sounds interesting..... more so than what I thought which was a drunken scummer just smacking your car up.

Yes knew person that did it, long story short, Id been giving her driving lessons, Saturday night she asked and I said no, her, her boyfriend and his mate got nasty as apparently it was ruining there night. Heard a massive thump at side of my and things kicked of from there.
