So if the rear silencer was angled down that would cure your problem?...

JDM should make no difference to fit.
The only difference is in the length of the cat and a small difference in the angle and hole locations on the downpipe flange.
That does look low, but bear in mind that the exhaust has to allow for the bottom suspension arm to drop, so there does need to be a bit more clearance than you might think at first.
If you jack the back of the car up so that the wheels are off the ground, have you still got lots of clearance between the lower suspension arm and the top of the exhaust pipe? If not, it just means that the exhaust wasn't very 'elegantly' manufactured (they didn't bother to sweep it back up after ducking under the suspension arm).
EDIT:
Hang on... I think they've refitted the rubber hanger near the suspension arm, onto completely the wrong thing? The hanger looks like it's mounted below even where the exhaust pipe should sit! So they must have put it back on the wrong thing?

Actually, that hanger I'm talking about, has been fitted on the wrong side by the looks? Looks like it goes off towards the passenger side of the car? It should go off towards the drivers side.
If I'm right, then it's not surprising they haven't attached it properly?

The back box has two hangers but they are in different locations from the original back box.
The hanger in the middle section won't go any higher as the tailpipes rub on the back bumper and won't go any higher. It looks like it would fit nicely if it could be moulded into shape, as the hangers line up with the hooks for the pipe I just cant make it reach.
Can the pipe be bent into shape? It looks like if it can be straightened where the bends are next to the back box then it will fit nicely

Putting that hanger near the suspension arm on should have the opposite effect - it should increase clearance of the tailpipe under the bumper.
The hanger at the very back of the exhaust is the very last one you put on. The one near the suspension arm should be pretty much the first one. If they do them in the wrong order, that might be what's causing the problem? I remember I struggled to get the exhaust on my 3g sit right, until I sussed out which order to fit the hangers, then it was a doddle.

This makes sense and would work but it's impossible to get the middle hanger hooked as the tailpipe jams the pipe too far away from the hanger. Comparing ur exhaust pics it does look like the pipe on mine has been bent and shaped upward about 8inches from the back box. Looks in about the right place length wise, but it's mounted on the opposite side to the oem and the aftermarket one I pictured. If it's bent correctly, that probably doesn't matter too much, but that's where I'd start looking if I were you.
The hangers on the back box aren't right though - it should have one at the back of the back box on the passenger side and one on the front of the back box on the drivers side. The one at the front of the back box probably isn't critical, so long as the hanger near the suspension arm is right.
At the end of the day, if it fitted right on another lude, then assuming that lude hadn't had its hanger mounts modified, then it should fit fine on yours, just need to suss out what's not quite right.
