Crap luck, Mick.

Not wishing to sound too presumptuous but he sounded like a decent human until the neck injury stuff. Maybe I'm doing him a disservice, but it's depressing how many folks morals dissolve in money.

Good luck with it.

I still have problems with my neck 16yrs after writing off my old granada, and admit the pain wasn't too bad immediately after the accident but came on worse a few hours later - and particularly the next day. That said though, I don't think an impact that didn't wake children would have caused that damage!
I think you're going to be better off going through the insurance if they are playing the whiplash card, but might be worth offering £100-200 to pay for physio? I don't know if you could get them to sign a waiver accepting that the payment covering treatment costs addresses your liability, for personal injury, in full?
Hope you get things sorted one way or the other.

Stop giving yourself a heart attack, that's what insurance companies are for, its not worth your while offering to pay for his damage of, presumably , several hundred, if not a thousandish pounds out of your own pocket, you're creating more trouble than its worth, Agreed on your machine, tho' , with the help of others, best to repair yourself than only get the insurance company to write it off, having said that, my insurance paid over 800 quid not long ago for a rear bumper for my 3g, its actual value at the time? Possibly not even the 800 quid they paid for the bumper, but the assessor told them it was woth it due to the overall condition of the car, despite it's age

Even if the neck thing is a try-on, it could get messy. If it's genuine, it could run and run. In all likelihood, she'll be sent to a specialist who'll say that it's not too bad BUT can't guarantee that it won't get worse. Your insurance must pay - you don't want a claim to come out of the woodwork in a few years down the road.
Unless he's daft, you can't expect him to sign a waiver, either.

It's his call, really. You can't offer to pay out of your own pocket if he wants to go through the insurance. And you shouldn't do so unless you've got some control over the job and its costs.
