Have you tried tightening the sump bolts up?? They will usually work loose, even when tight!!

That sucks a bit
Is it definitely not just sump bolts too loose? They're a difficult one to judge... Overtighten and the sump bends and it's as bad as having them too loose.
If you drop the sump, check that the mating faces are flat (sump lip not bent).

possibly, need to take it apart to be certain :/So Benny being fully aware that the gasket was leaking has bodged it to make a sale?
yeah tomorrows job will be to take it off and check it all over. Not something i wanted to do or have the money for but needs must.
Do you think that CPA or Euros n that will have a gasket? I'm not sure they will though but cant really have the car sitting as i need to drive it

This gasket on ebay is the only one i could find that could be compatible

As for taking the sump off, would i have to take the 'scrape plate' off, exhaust manifold and jack the gearbox to hold the engine? i tightened about 8 of the bolts, but i couldn't get to the rest. I didn't over tighten them but at least 4 were a bit too loose

Cheers for the help guys, must appreciated

From memory you need to drop the centre beam too.
For tightening the sump bolts, the torque setting Honda specify in the service manual is 10NM

It's the bar to the left of the downpipe in this pic mate

It's easy to remove
it's just bolted to the front and rear subframe at either end. Midway along it has a bracket that supports the gearbox, but they're not physically connected so nothing to undo there.

It's easy to remove
