mot dilema

ok, i have a spoiler with brake light, not fitted as std. last mot it wasnt there, but this year it will be as mot is looming. at the moment i still have both brake lights and the high level light, the brake light in the spoiler isnt wired in, so will it fail on brake light not working, also can anyone see a problem if i wire it to the fog and use it as such?

currently has a red led in the reverse lamp.

Mines just passed without a centre brake light (both the spoiler and window one don't work).
It was an advisory though as they can only fail it if it's obviously damaged, if it's just disconnected it's a pass. The tester isn't allowed to remove anything in the test so as the wires and connections are hidden away they have to assume it's disconnected.

Finally found it in the MOT guidelines.
Item 7 High level brake lamps
Some vehicles are fitted with what appears to be a high level stop lamp, but which in fact is
not connected to the wiring loom. In this case it is not a ‘lamp’ for the purposes of the MOT
test.
The difficulty is knowing this, as you are not permitted to dismantle.
When extra lamps are fitted and there is doubt whether they are connected, the benefit of
this doubt should be given to the presenter and ‘pass and advise’ is the correct
course of action.
All lamps that light when the foot brake is applied must meet the criteria laid down in the
inspection manual.

you just have to spend a couple of hours every year taking all the naughty bits off. crawl under for the cat etc...
if it were me i would just take the spoiler off for the day. if there is no light then it cant be checked.....
